Purpose and scope<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms of Use (the \u201c<strong>Terms<\/strong>\u201d) govern access to and use of the websites, platforms, subdomains and digital services operated by <strong>Fondation H\u00e9ritage Montr\u00e9al<\/strong>, hereinafter \u201c<strong>H\u00e9ritage Montr\u00e9al<\/strong>\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They apply in particular to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>H\u00e9ritage Montr\u00e9al\u2019s main website;<\/li>\n\n\n<li>the blog and editorial content published by H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>the <strong>Memento<\/strong> platform;<\/li>\n\n\n<li>maps, databases, search tools and interactive features;<\/li>\n\n\n<li>forms;<\/li>\n\n\n<li>download areas;<\/li>\n\n\n<li>documentation, publication and archive pages;<\/li>\n\n\n<li>and other digital services operated by H\u00e9ritage Montr\u00e9al under its domains or subdomains.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These various services are collectively referred to as the \u201c<strong>Sites<\/strong>\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By accessing or using the Sites, the user acknowledges having read these Terms and agrees to comply with them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Certain features or external platforms may be subject to their own terms of use. Where specific terms are expressly presented to the user for a given service, those terms apply to that service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Use of the Sites is also subject to H\u00e9ritage Montr\u00e9al\u2019s <strong>Privacy and Personal Information Protection Policy<\/strong>, which is a separate document from these Terms.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-2-heritage-montreal\" class=\"wp-block-heading\">2. Purpose of the Sites<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sites are intended, in particular, to contribute to H\u00e9ritage Montr\u00e9al\u2019s mission of advancing knowledge, awareness, protection, enhancement and transmission of the metropolitan region\u2019s architectural, urban, landscape and cultural heritage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Sites may include, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>news;<\/li>\n\n\n<li>articles and blog content;<\/li>\n\n\n<li>thematic features;<\/li>\n\n\n<li>positions and statements;<\/li>\n\n\n<li>resolutions;<\/li>\n\n\n<li>news releases;<\/li>\n\n\n<li>research and analysis;<\/li>\n\n\n<li>publications;<\/li>\n\n\n<li>reports;<\/li>\n\n\n<li>briefs and submissions;<\/li>\n\n\n<li>historical documents;<\/li>\n\n\n<li>photographs and audiovisual content;<\/li>\n\n\n<li>maps;<\/li>\n\n\n<li>inventories;<\/li>\n\n\n<li>documentary references;<\/li>\n\n\n<li>educational resources;<\/li>\n\n\n<li>information relating to H\u00e9ritage Montr\u00e9al\u2019s activities, actions, campaigns and programs;<\/li>\n\n\n<li>information concerning buildings, sites, complexes and territories;<\/li>\n\n\n<li>citizen participation and mobilization tools;<\/li>\n\n\n<li>data from institutional or third-party sources;<\/li>\n\n\n<li>and various digital services and features.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The content, structure and features of the Sites may evolve over time.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-4-editorial-content-publications-and-positions\" class=\"wp-block-heading\">4. Editorial content, publications and positions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al\u2019s main website and blog serve, among other things, as spaces for information, documentation, awareness, analysis, mobilization and expression of the organization\u2019s activities and concerns.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Certain content may express an analysis, recommendation, concern, institutional position or opinion concerning, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a building;<\/li>\n\n\n<li>a heritage complex;<\/li>\n\n\n<li>a real estate project;<\/li>\n\n\n<li>a development project;<\/li>\n\n\n<li>a public policy;<\/li>\n\n\n<li>a government or municipal decision;<\/li>\n\n\n<li>a public consultation;<\/li>\n\n\n<li>a by-law or regulation;<\/li>\n\n\n<li>or any other issue related to H\u00e9ritage Montr\u00e9al\u2019s mission.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Such content must be understood <strong>in the context and as of the date of its publication<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A situation may evolve after content is published, including as a result of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a change to a project;<\/li>\n\n\n<li>a new public decision;<\/li>\n\n\n<li>a regulatory change;<\/li>\n\n\n<li>new information becoming available;<\/li>\n\n\n<li>an intervention by an owner or public authority;<\/li>\n\n\n<li>a real estate transaction;<\/li>\n\n\n<li>a restoration;<\/li>\n\n\n<li>a transformation;<\/li>\n\n\n<li>a demolition;<\/li>\n\n\n<li>or the evolution of a file or of H\u00e9ritage Montr\u00e9al\u2019s position.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al has no obligation to retrospectively amend each of its articles, news releases, publications, positions or historical documents so that they reflect the current status of a file.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The publication date of any content must therefore always be taken into consideration by the user.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The continued online availability of older content does not mean that H\u00e9ritage Montr\u00e9al necessarily reiterates or confirms, at the time it is consulted, each item of information, analysis or position presented in that content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where content is signed or produced by a contributor, expert, partner, guest author or other third party, the opinions expressed do not necessarily represent those of H\u00e9ritage Montr\u00e9al unless otherwise indicated.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-5-nature-accuracy-and-value-of-information\" class=\"wp-block-heading\">5. Nature, accuracy and value of information<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al takes particular care with the quality of the information published on its Sites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, content may come from numerous sources and may concern buildings, territories, projects, public decisions, administrative matters, heritage protections, regulations or situations that may change rapidly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite reasonable efforts to ensure quality and updating, <strong>H\u00e9ritage Montr\u00e9al does not guarantee that information available on the Sites will at all times be accurate, exhaustive, complete, current or free of errors or omissions.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Information published on the Sites is provided <strong>exclusively for informational, awareness, documentation and mobilization purposes<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is general in nature and <strong>does not under any circumstances constitute an official source, professional advice, expert opinion, recommendation, official interpretation or guarantee<\/strong>, including with respect to matters that are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>legal;<\/li>\n\n\n<li>regulatory;<\/li>\n\n\n<li>urban-planning id=\"h-5-1-primacy-of-official-sources\" class=\"wp-block-heading\">5.1 Primacy of official sources<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No information published on the Sites should be used as a substitute for laws, regulations, registers, permits, decisions, notices, maps, inventories, assessment rolls, databases or official documents issued by the competent authorities.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where information concerns, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the heritage status of a property;<\/li>\n\n\n<li>a heritage designation or protection;<\/li>\n\n\n<li>a classification or citation;<\/li>\n\n\n<li>a heritage inventory;<\/li>\n\n\n<li>zoning;<\/li>\n\n\n<li>an authorized use;<\/li>\n\n\n<li>an applicable standard;<\/li>\n\n\n<li>an easement;<\/li>\n\n\n<li>a by-law or regulation;<\/li>\n\n\n<li>a permit;<\/li>\n\n\n<li>an authorization;<\/li>\n\n\n<li>a demolition application;<\/li>\n\n\n<li>an application for a regulatory amendment;<\/li>\n\n\n<li>a real estate project;<\/li>\n\n\n<li>an administrative decision;<\/li>\n\n\n<li>a public consultation;<\/li>\n\n\n<li>a proceeding before a public authority;<\/li>\n\n\n<li>ownership or the legal characteristics of a property;<\/li>\n\n\n<li>or any other situation that may have legal, administrative or regulatory effects,<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>the user must verify the information directly with the competent authority and consult the applicable official documents before making any decision or taking any action.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>In the event of any discrepancy, incompatibility or contradiction between information published on the Sites and information from an official source, the official source prevails in all cases.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, H\u00e9ritage Montr\u00e9al does not guarantee that a page, record, map, publication or article will immediately reflect:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the adoption or amendment of a by-law or regulation;<\/li>\n\n\n<li>the issuance, amendment or cancellation of a permit;<\/li>\n\n\n<li>a change in the heritage status of a place;<\/li>\n\n\n<li>a recent administrative decision;<\/li>\n\n\n<li>a change made to a project;<\/li>\n\n\n<li>a sale or change of ownership;<\/li>\n\n\n<li>a court decision;<\/li>\n\n\n<li>a change to a government or municipal database;<\/li>\n\n\n<li>or any other development occurring since its most recent update.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Information may therefore have been accurate when published but no longer correspond to the current situation when consulted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Any person who chooses to act, refrain from acting, enter into a transaction or make a decision based solely on information published on the Sites does so at their own risk and remains responsible for carrying out the necessary verifications with the relevant sources, professionals and competent authorities.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-6-documents-publications-and-downloadable-content\" class=\"wp-block-heading\">6. Documents, publications and downloadable content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sites may allow users to consult, download, print or export various documents, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>reports;<\/li>\n\n\n<li>briefs and submissions;<\/li>\n\n\n<li>publications;<\/li>\n\n\n<li>guides;<\/li>\n\n\n<li>maps;<\/li>\n\n\n<li>news releases;<\/li>\n\n\n<li>articles;<\/li>\n\n\n<li>records;<\/li>\n\n\n<li>data;<\/li>\n\n\n<li>historical documents;<\/li>\n\n\n<li>or other resources.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The technical ability to download, print or save a document <strong>does not constitute a waiver of any intellectual property rights that may apply to it<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rights of reproduction and reuse are determined by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the notices accompanying the document;<\/li>\n\n\n<li>these Terms;<\/li>\n\n\n<li>any applicable specific licences;<\/li>\n\n\n<li>rights belonging to third parties;<\/li>\n\n\n<li>and applicable laws.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a document includes a date, version number or notice indicating that it has been replaced or archived, the user must take that information into account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al may keep older or archived documents online for historical, documentary or reference purposes, without their continued availability necessarily meaning that they represent current information.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-7-acceptable-use-of-the-sites\" class=\"wp-block-heading\">7. Acceptable use of the Sites<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The user agrees to use the Sites lawfully and reasonably and not to compromise their operation, security or integrity or the rights of others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, it is prohibited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>attempt to obtain unauthorized access to the Sites or their servers, systems or databases;<\/li>\n\n\n<li>circumvent a security measure or access restriction;<\/li>\n\n\n<li>intentionally introduce a virus, malicious software or any other harmful element;<\/li>\n\n\n<li>compromise or attempt to compromise the security of the Sites;<\/li>\n\n\n<li>unreasonably disrupt or overload their infrastructure;<\/li>\n\n\n<li>impersonate H\u00e9ritage Montr\u00e9al or one of its representatives;<\/li>\n\n\n<li>falsely represent an association, approval, sponsorship or partnership with H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>use the Sites for fraudulent, defamatory or unlawful purposes;<\/li>\n\n\n<li>automatically or massively collect personal information relating to users;<\/li>\n\n\n<li>systematically reproduce or extract protected content in violation of these Terms, an applicable licence or the law.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These restrictions must not be interpreted as limiting rights expressly granted in respect of <strong>open data<\/strong> or content subject to a specific licence.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-8-heritage-montreal-intellectual-property\" class=\"wp-block-heading\">8. H\u00e9ritage Montr\u00e9al intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to rights belonging to third parties and content expressly made available under a different licence, original content on the Sites is protected by applicable copyright, trademark and intellectual property laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This may include, as applicable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>texts;<\/li>\n\n\n<li>articles;<\/li>\n\n\n<li>features;<\/li>\n\n\n<li>publications;<\/li>\n\n\n<li>research;<\/li>\n\n\n<li>analyses;<\/li>\n\n\n<li>photographs;<\/li>\n\n\n<li>videos;<\/li>\n\n\n<li>illustrations;<\/li>\n\n\n<li>maps;<\/li>\n\n\n<li>graphic representations;<\/li>\n\n\n<li>compilations;<\/li>\n\n\n<li>the structure and organization of databases;<\/li>\n\n\n<li>interfaces;<\/li>\n\n\n<li>graphic elements;<\/li>\n\n\n<li>logos;<\/li>\n\n\n<li>trademarks;<\/li>\n\n\n<li>program names;<\/li>\n\n\n<li>and the design of the Sites.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Except where permitted by law, an applicable licence or authorization from H\u00e9ritage Montr\u00e9al, such content may not be reproduced, adapted, distributed, republished or substantially exploited without the authorization of the rights holder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to third-party rights, it is permitted to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>create a hyperlink to a public page;<\/li>\n\n\n<li>use the sharing tools made available on the Sites;<\/li>\n\n\n<li>make a copy or printout for personal consultation;<\/li>\n\n\n<li>and quote excerpts in accordance with applicable laws, with acknowledgement of the source.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Substantial or systematic reproduction of content, creation of a new database from protected content or republication of content in its entirety requires authorization, except where the content concerned is expressly made available under a licence permitting such use.<\/p>\n\n\n\n<h3 id=\"h-8-1-trademarks-and-visual-identity\" class=\"wp-block-heading\">8.1 Trademarks and visual identity<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Names, logos, trademarks and visual identities belonging to H\u00e9ritage Montr\u00e9al may not be used in a manner likely to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>create confusion as to the origin of content;<\/li>\n\n\n<li>suggest approval;<\/li>\n\n\n<li>suggest sponsorship;<\/li>\n\n\n<li>suggest an official association or partnership;<\/li>\n\n\n<li>or harm H\u00e9ritage Montr\u00e9al\u2019s image or rights.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any such use requires prior authorization.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-9-photographs-archives-and-third-party-content\" class=\"wp-block-heading\">9. Photographs, archives and third-party content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sites may reproduce or display photographs, plans, archival documents, maps, illustrations, excerpts from publications, works, data or other content belonging to third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a source, credit, collection or rights notice accompanies content, those indications must be respected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The availability of content on the Sites does not mean that H\u00e9ritage Montr\u00e9al holds all rights in that content or that it may be freely reproduced.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person wishing to reuse such content is responsible for verifying the applicable rights and, where necessary, obtaining authorization from the relevant rights holder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any authorization granted by H\u00e9ritage Montr\u00e9al can apply only to rights that H\u00e9ritage Montr\u00e9al itself is authorized to grant.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-10-hyperlinks-and-external-content\" class=\"wp-block-heading\">10. Hyperlinks and external content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sites may contain links to, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>government or municipal websites;<\/li>\n\n\n<li>public databases;<\/li>\n\n\n<li>heritage institutions;<\/li>\n\n\n<li>partner organizations;<\/li>\n\n\n<li>media outlets;<\/li>\n\n\n<li>publications;<\/li>\n\n\n<li>social media platforms;<\/li>\n\n\n<li>video platforms;<\/li>\n\n\n<li>maps;<\/li>\n\n\n<li>or other external websites and services.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These links are generally provided for informational or convenience purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al does not necessarily control the content, availability, evolution, security or practices of external websites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of a hyperlink <strong>does not, unless expressly indicated otherwise, constitute an endorsement of all content, products, services, policies or opinions of the external website.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A link may also become outdated or lead to content that has been moved, removed or modified.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-11-services-and-platforms-operated-by-third-parties\" class=\"wp-block-heading\">11. Services and platforms operated by third parties<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Certain features accessible through the Sites may be provided in whole or in part by external providers or platforms, including in relation to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>payments;<\/li>\n\n\n<li>donations;<\/li>\n\n\n<li>memberships;<\/li>\n\n\n<li>online store services;<\/li>\n\n\n<li>electronic communications;<\/li>\n\n\n<li>multimedia content;<\/li>\n\n\n<li>mapping;<\/li>\n\n\n<li>forms;<\/li>\n\n\n<li>hosting;<\/li>\n\n\n<li>or technology services.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">When the user accesses a service operated by a third party, that service may be subject to the third party\u2019s terms, policies and practices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al does not control changes made by these providers to their services, terms, policies or platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The collection and processing of personal information by H\u00e9ritage Montr\u00e9al and its providers are described in greater detail in H\u00e9ritage Montr\u00e9al\u2019s <strong>Privacy and Personal Information Protection Policy<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-12-donations-memberships-online-store-and-other-transactions\" class=\"wp-block-heading\">12. Donations, memberships, online store and other transactions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The main website may allow the user, in particular, to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>make a donation;<\/li>\n\n\n<li>become a member or renew a membership;<\/li>\n\n\n<li>make a purchase;<\/li>\n\n\n<li>or carry out certain other transactions.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Information, prices, taxes, delivery terms, benefits or other details specific to a transaction are those presented at the time the transaction is carried out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An obvious technical or typographical error appearing on a Site does not bind H\u00e9ritage Montr\u00e9al where it can reasonably be identified as such, subject to any mandatory rights provided by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payments may be processed by specialized providers. H\u00e9ritage Montr\u00e9al does not necessarily receive all financial information transmitted directly to the payment provider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>These Terms do not establish specific rules applicable to ticketing or to the conduct of H\u00e9ritage Montr\u00e9al activities.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-13-forms-and-communications-submitted-to-heritage-montreal\" class=\"wp-block-heading\">13. Forms and communications submitted to H\u00e9ritage Montr\u00e9al<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sites may allow a user to submit, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a question;<\/li>\n\n\n<li>a comment;<\/li>\n\n\n<li>a request;<\/li>\n\n\n<li>a document;<\/li>\n\n\n<li>a photograph;<\/li>\n\n\n<li>a suggestion;<\/li>\n\n\n<li>a correction;<\/li>\n\n\n<li>an application;<\/li>\n\n\n<li>a report or notice;<\/li>\n\n\n<li>a documentary contribution;<\/li>\n\n\n<li>or any other information.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The user must submit information in good faith and must not use forms to knowingly communicate content that is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>false or misleading;<\/li>\n\n\n<li>fraudulent;<\/li>\n\n\n<li>defamatory;<\/li>\n\n\n<li>threatening;<\/li>\n\n\n<li>hateful;<\/li>\n\n\n<li>unlawful;<\/li>\n\n\n<li>infringing privacy;<\/li>\n\n\n<li>or infringing a third party\u2019s intellectual property rights.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The user must submit only personal information reasonably necessary for the purpose of the communication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Specific terms applicable to contributions intended to be published or integrated into <strong>Memento<\/strong> are set out below.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 id=\"h-provisions-specific-to-memento\" class=\"wp-block-heading\">PROVISIONS SPECIFIC TO MEMENTO<\/h1>\n\n\n\n<h2 id=\"h-14-nature-and-purpose-of-memento\" class=\"wp-block-heading\">14. Nature and purpose of Memento<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Memento is an information, documentation, awareness and mobilization platform devoted in particular to metropolitan heritage, places of heritage interest and the issues affecting them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Memento may, in particular, allow users to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>locate and discover places;<\/li>\n\n\n<li>consult documentary records;<\/li>\n\n\n<li>view geographic information;<\/li>\n\n\n<li>consult issues associated with certain sites;<\/li>\n\n\n<li>access external references and sources;<\/li>\n\n\n<li>relate different data to one another;<\/li>\n\n\n<li>report a situation or heritage issue;<\/li>\n\n\n<li>contribute to enriching certain information;<\/li>\n\n\n<li>consult data;<\/li>\n\n\n<li>and download or reuse certain data where the applicable rights permit.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Information compiled in Memento may come, in particular, from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>the City of Montr\u00e9al;<\/li>\n\n\n<li>other municipalities;<\/li>\n\n\n<li>the Government of Qu\u00e9bec;<\/li>\n\n\n<li>the Government of Canada;<\/li>\n\n\n<li>other public bodies;<\/li>\n\n\n<li>open databases;<\/li>\n\n\n<li>inventories;<\/li>\n\n\n<li>archives;<\/li>\n\n\n<li>publications;<\/li>\n\n\n<li>studies;<\/li>\n\n\n<li>partners;<\/li>\n\n\n<li>researchers;<\/li>\n\n\n<li>citizens;<\/li>\n\n\n<li>property owners;<\/li>\n\n\n<li>or other third parties.<\/li>\n\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-15-memento-is-not-an-official-register\" class=\"wp-block-heading\">15. Memento is not an official register<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Memento is not an official register and does not replace any register, inventory, assessment roll, map, geographic information system, database or document produced by a public authority.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The inclusion of a building, place, complex or territory in Memento:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not confer any legal status on it;<\/li>\n\n\n<li>does not constitute an official heritage designation;<\/li>\n\n\n<li>does not necessarily mean that it benefits from legal protection;<\/li>\n\n\n<li>does not confirm its zoning;<\/li>\n\n\n<li>does not confirm the uses permitted there;<\/li>\n\n\n<li>and does not constitute a decision or position of a public authority.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Conversely, the absence of a place from Memento does not mean:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>that it has no heritage value;<\/li>\n\n\n<li>that it benefits from no protection;<\/li>\n\n\n<li>that no regulation applies to it;<\/li>\n\n\n<li>that it is not affected by any issue;<\/li>\n\n\n<li>or that no administrative or regulatory proceeding is underway.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The user must consult official sources and authorities to determine the current legal, regulatory, heritage or administrative status of a place.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-16-compilation-and-updating-of-memento-records\" class=\"wp-block-heading\">16. Compilation and updating of Memento records<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Memento records may result from the combination of several sources with different methods, objectives, reference dates and update frequencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Information may, in particular, have been:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>imported;<\/li>\n\n\n<li>transcribed;<\/li>\n\n\n<li>selected;<\/li>\n\n\n<li>grouped;<\/li>\n\n\n<li>geolocated;<\/li>\n\n\n<li>normalized;<\/li>\n\n\n<li>adapted;<\/li>\n\n\n<li>contextualized;<\/li>\n\n\n<li>enriched;<\/li>\n\n\n<li>or related to other information.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The date on which Memento is updated may therefore differ from the date of the original source.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al does not guarantee instantaneous or permanent synchronization with the databases of source institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the accuracy or currency of data is important to the user, <strong>the user must consult the original source directly.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-17-citizen-alerts-and-reports\" class=\"wp-block-heading\">17. Citizen alerts and reports<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Memento may allow members of the public to report a situation concerning a place or heritage complex.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An alert or report may concern, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a risk of demolition;<\/li>\n\n\n<li>vacancy;<\/li>\n\n\n<li>poor maintenance;<\/li>\n\n\n<li>a transformation;<\/li>\n\n\n<li>a real estate project;<\/li>\n\n\n<li>the loss of heritage elements;<\/li>\n\n\n<li>or any other situation considered to be of concern.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>An alert or report published on Memento does not constitute an official finding, professional expert opinion, legal determination or conclusion as to whether a situation is lawful or unlawful.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Publication of information from a third party does not mean that H\u00e9ritage Montr\u00e9al guarantees or confirms all statements submitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al may, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>verify;<\/li>\n\n\n<li>request clarification;<\/li>\n\n\n<li>supplement;<\/li>\n\n\n<li>correct;<\/li>\n\n\n<li>reword;<\/li>\n\n\n<li>contextualize;<\/li>\n\n\n<li>merge;<\/li>\n\n\n<li>classify;<\/li>\n\n\n<li>update;<\/li>\n\n\n<li>refuse;<\/li>\n\n\n<li>suspend;<\/li>\n\n\n<li>archive;<\/li>\n\n\n<li>or remove<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">a contribution or alert.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al remains free to determine the content it publishes in Memento.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-18-contributions-to-memento-and-cc-by-4-0-licence\" class=\"wp-block-heading\">18. Contributions to Memento and CC BY 4.0 licence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When a user submits to H\u00e9ritage Montr\u00e9al text, a photograph, information, a correction, a reference, a document or any other content intended to be integrated into <strong>Memento<\/strong>, the user remains the holder of any rights they have in that content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>By submitting content intended for publication in Memento, the user agrees that the content will be made available to the public under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence, to the extent of the rights the user holds in that content.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to its terms, the <strong>CC BY 4.0<\/strong> licence allows any person, in particular, to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copy and redistribute the content in any medium or format;<\/li>\n\n\n<li>adapt, transform or build upon it;<\/li>\n\n\n<li>combine it with other information;<\/li>\n\n\n<li>integrate it into another database or publication;<\/li>\n\n\n<li>and use it for commercial or non-commercial purposes.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Reuse must comply with the attribution requirements set out in the licence, including, as applicable, appropriately crediting the source or author, referring to the applicable licence and indicating changes made where required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The user therefore understands that content submitted to Memento and published under this licence may be <strong>reused, reproduced, adapted, redistributed and incorporated into other works, publications, tools or databases by third parties<\/strong>, without further authorization being required, provided that the CC BY 4.0 licence is respected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Publication under this licence <strong>does not transfer ownership of copyright to H\u00e9ritage Montr\u00e9al<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By submitting content intended for Memento, the user represents, to the extent applicable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>that they are the author of the content or hold the rights necessary to permit its distribution under the CC BY 4.0 licence;<\/li>\n\n\n<li>that they are authorized to submit and make the content public;<\/li>\n\n\n<li>that the content does not include third-party rights incompatible with this licence, except where those rights are clearly identified;<\/li>\n\n\n<li>that publication of the content does not infringe copyright, image rights, privacy or any other third-party right;<\/li>\n\n\n<li>and that the information submitted is provided in good faith.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a contribution includes an element belonging to a third party, including a photograph, work, plan, archival document or any other protected content, <strong>the CC BY 4.0 licence applies to that element only if the person submitting the contribution actually has the right to offer it under that licence.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elements whose rights belong to third parties and that cannot be distributed under CC BY 4.0 must be identified as such.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al may, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>verify;<\/li>\n\n\n<li>correct;<\/li>\n\n\n<li>reword;<\/li>\n\n\n<li>summarize;<\/li>\n\n\n<li>translate;<\/li>\n\n\n<li>geolocate;<\/li>\n\n\n<li>normalize;<\/li>\n\n\n<li>contextualize;<\/li>\n\n\n<li>combine;<\/li>\n\n\n<li>or adapt<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">a contribution before or after publication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a modification is made to content distributed under CC BY 4.0, the modification may be indicated in accordance with the requirements of that licence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al remains free to refuse, suspend, modify, archive or remove any contribution from Memento.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Unless otherwise specifically indicated in connection with particular content, contributions submitted to Memento under this section and actually published as open data or open content are distributed under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 id=\"h-open-data\" class=\"wp-block-heading\">OPEN DATA<\/h1>\n\n\n\n<h2 id=\"h-19-data-from-open-sources\" class=\"wp-block-heading\">19. Data from open sources<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Memento may integrate, reproduce, import, map, transform, combine or allow users to consult data from open data portals or other institutional sources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rights applicable to such data are determined by the institutions that make them available and by the licences associated with them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>H\u00e9ritage Montr\u00e9al does not claim ownership of data belonging to third parties merely because the data are accessible or presented in Memento.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a specific licence accompanies a dataset, <strong>that licence prevails over the general provisions of these Terms with respect to the rights to reuse that dataset.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-20-data-already-made-public-by-source-institutions\" class=\"wp-block-heading\">20. Data already made public by source institutions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Data identified as open data and integrated, reproduced or reused in Memento come from sources that have <strong>previously made them publicly accessible<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These may include, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the <strong>City of Montr\u00e9al<\/strong>, through its open data portal;<\/li>\n\n\n<li>the <strong>Government of Qu\u00e9bec<\/strong>, including through <strong>Donn\u00e9es Qu\u00e9bec<\/strong>;<\/li>\n\n\n<li>the <strong>Government of Canada<\/strong>, including through the <strong>Open Government Portal<\/strong>;<\/li>\n\n\n<li>other municipalities;<\/li>\n\n\n<li>other public bodies;<\/li>\n\n\n<li>or other institutions that make their data available under an open licence.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These data were made public by their source institution <strong>before being integrated into Memento<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>H\u00e9ritage Montr\u00e9al is not responsible for their initial publication or for the decision to make them publicly accessible.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Memento serves, in particular, as a tool for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>reuse;<\/li>\n\n\n<li>aggregation;<\/li>\n\n\n<li>selection;<\/li>\n\n\n<li>organization;<\/li>\n\n\n<li>contextualization;<\/li>\n\n\n<li>mapping;<\/li>\n\n\n<li>linking;<\/li>\n\n\n<li>visualization;<\/li>\n\n\n<li>and dissemination<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">of data already made public by their source.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of such data in Memento <strong>does not, in itself, constitute disclosure by H\u00e9ritage Montr\u00e9al of information that was previously private or confidential.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of public data in Memento does not alter its source, status or applicable licence.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-21-open-data-and-personal-information\" class=\"wp-block-heading\">21. Open data and personal information<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The preceding section applies only to data or information that the source institution has actually chosen to make public or distribute as part of an open dataset.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The mere fact that information can be found somewhere on the Internet does not mean that it constitutes open data or that it may be freely collected, reproduced or distributed.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where open data include information concerning a person, H\u00e9ritage Montr\u00e9al relies, in particular, on the fact that the information was previously made public by the competent institution as part of the dataset concerned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a person believes that information from an institutional source:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>is inaccurate;<\/li>\n\n\n<li>should no longer be public;<\/li>\n\n\n<li>should be corrected;<\/li>\n\n\n<li>or should be removed from the original dataset,<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>the institution that published the data remains the official reference source for any request concerning the original publication, its accuracy or its public status.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al may nevertheless review a request concerning the display of that data in Memento and take any measures it considers appropriate, subject to its legal obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where data are corrected, modified or removed by their official source, H\u00e9ritage Montr\u00e9al may reflect that change in Memento according to its update processes and cycles.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-22-city-of-montreal-open-data\" class=\"wp-block-heading\">22. City of Montr\u00e9al open data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Certain data used in Memento may come from the <strong>City of Montr\u00e9al<\/strong> open data portal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the data concerned are made available under the <strong>Creative Commons Attribution 4.0 International (CC BY 4.0) licence<\/strong>, their use and reuse remain governed by that licence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of these data in Memento:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not transfer ownership of the data to H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>does not alter their licence;<\/li>\n\n\n<li>does not reduce the rights granted directly by that licence;<\/li>\n\n\n<li>does not mean that H\u00e9ritage Montr\u00e9al was responsible for their publication;<\/li>\n\n\n<li>and does not mean that the City of Montr\u00e9al approves, sponsors or endorses H\u00e9ritage Montr\u00e9al, Memento or any particular reuse of the data.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where the data are selected, organized, contextualized, enriched, mapped or combined with content produced by H\u00e9ritage Montr\u00e9al, any rights that may exist in those separate contributions do not alter the licence applicable to the original municipal data.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-23-government-of-quebec-data-and-donnees-quebec\" class=\"wp-block-heading\">23. Government of Qu\u00e9bec data and Donn\u00e9es Qu\u00e9bec<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Memento may also reuse datasets made public by the <strong>Government of Qu\u00e9bec<\/strong>, its departments, bodies or partners, including through <strong>Donn\u00e9es Qu\u00e9bec<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each dataset remains subject to the licence identified by its producer or distributor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a dataset is distributed under a Creative Commons licence, the user\u2019s reuse rights and obligations are determined by the licence variant indicated in the record or metadata for the dataset concerned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The licence indicated by the original source of the dataset prevails in all cases.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Integration of these data into Memento:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not alter their licence;<\/li>\n\n\n<li>does not transfer ownership of them to H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>and does not mean that the Government of Qu\u00e9bec or the producing body approves or endorses Memento or the use made of the data.<\/li>\n\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-24-government-of-canada-data\" class=\"wp-block-heading\">24. Government of Canada data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Memento may also integrate or reuse data and information made public by the <strong>Government of Canada<\/strong>, including through the <strong>Open Government Portal<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a dataset is made available under the <strong>Open Government Licence \u2013 Canada<\/strong>, its reuse remains subject to the terms of that licence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Integration of these data into Memento:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not alter their licence;<\/li>\n\n\n<li>does not transfer ownership of them to H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>does not mean that H\u00e9ritage Montr\u00e9al was responsible for their publication;<\/li>\n\n\n<li>and does not mean that the Government of Canada approves or endorses Memento or the use made of these data.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where different terms or a different licence are expressly indicated by the source of a dataset, those terms or licence prevail.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-25-attribution-and-reuse-of-open-data\" class=\"wp-block-heading\">25. Attribution and reuse of open data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where a licence requires acknowledgement of the source, the user reusing the data is responsible for complying with that requirement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the applicable licence, attribution may be required to identify, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the producing or distributing institution;<\/li>\n\n\n<li>the name of the dataset;<\/li>\n\n\n<li>the applicable licence;<\/li>\n\n\n<li>the original source;<\/li>\n\n\n<li>and, where required, the fact that the data have been adapted or modified.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The user must verify the licence indicated by the original source before redistributing, publishing or reusing a dataset.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The open nature of a dataset does not mean that the other elements accompanying it in Memento are themselves distributed under the same licence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless otherwise indicated, a licence applicable to third-party data does not automatically extend, in particular, to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>editorial texts written by H\u00e9ritage Montr\u00e9al;<\/li>\n\n\n<li>analyses;<\/li>\n\n\n<li>comments;<\/li>\n\n\n<li>third-party photographs;<\/li>\n\n\n<li>illustrations;<\/li>\n\n\n<li>logos;<\/li>\n\n\n<li>trademarks;<\/li>\n\n\n<li>graphic identity;<\/li>\n\n\n<li>navigation elements;<\/li>\n\n\n<li>or other content added to the platform.<\/li>\n\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 id=\"h-privacy-operation-and-liability\" class=\"wp-block-heading\">PRIVACY, OPERATION AND LIABILITY<\/h1>\n\n\n\n<h2 id=\"h-26-protection-of-personal-information\" class=\"wp-block-heading\">26. Protection of personal information<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The collection, use, disclosure, retention and protection of personal information by H\u00e9ritage Montr\u00e9al are governed by its <strong>Privacy and Personal Information Protection Policy<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This policy applies in particular to information submitted through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>forms;<\/li>\n\n\n<li>donations;<\/li>\n\n\n<li>memberships;<\/li>\n\n\n<li>purchases;<\/li>\n\n\n<li>subscriptions to communications;<\/li>\n\n\n<li>alerts and reports;<\/li>\n\n\n<li>contributions;<\/li>\n\n\n<li>and other interactions with the Sites.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms do not replace that policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the user uses an external service, information processed directly by that provider may also be governed by that provider\u2019s policies and terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rules relating to open data already made public by source institutions are set out in sections 19 to 25 of these Terms.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-27-security-of-the-sites\" class=\"wp-block-heading\">27. Security of the Sites<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00e9ritage Montr\u00e9al takes reasonable measures to ensure the security and proper operation of its Sites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, <strong>no website, computer network or Internet transmission method can be guaranteed to be entirely free of vulnerabilities, interruptions or risks.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The user remains responsible for taking reasonable measures to protect their devices, systems, software, accounts and data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any attempt to compromise the security of the Sites or to access a system, database or information without authorization is prohibited.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-28-availability-and-operation\" class=\"wp-block-heading\">28. Limitation of liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To the fullest extent permitted by applicable law, H\u00e9ritage Montr\u00e9al cannot be held liable for damages arising, in particular, from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>inaccurate, incomplete, outdated or misinterpreted information;<\/li>\n\n\n<li>the use of unofficial information as the basis for a decision;<\/li>\n\n\n<li>an error or omission in data from a third party;<\/li>\n\n\n<li>a delay between an official source and its update on the Sites;<\/li>\n\n\n<li>a contribution or content submitted by a third party;<\/li>\n\n\n<li>an interruption or unavailability of the Sites;<\/li>\n\n\n<li>a technical error, failure or incompatibility;<\/li>\n\n\n<li>an external link or service;<\/li>\n\n\n<li>the modification or disappearance of external content;<\/li>\n\n\n<li>loss of access to a feature;<\/li>\n\n\n<li>or use of the Sites contrary to these Terms.<\/li>\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>In particular, H\u00e9ritage Montr\u00e9al does not guarantee that information published on the main website, blog or Memento may be used for the purposes of a real estate transaction, permit application, administrative or judicial proceeding, professional expert assessment or any other process having legal, administrative or financial effects.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the user\u2019s responsibility to obtain any necessary confirmation from the appropriate authorities, official sources or professionals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing in these Terms has the effect of excluding or limiting liability where such exclusion or limitation is prohibited by applicable law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-30-reporting-an-error-content-issue-or-infringement-of-rights\" class=\"wp-block-heading\">30.
