1. Purpose and scope

These Terms of Use (the “Terms”) govern access to and use of the websites, platforms, subdomains and digital services operated by Fondation Héritage Montréal, hereinafter “Héritage Montréal”.

They apply in particular to:

Héritage Montréal’s main website;
the blog and editorial content published by Héritage Montréal;
the Memento platform;
maps, databases, search tools and interactive features;
forms;
download areas;
documentation, publication and archive pages;
and other digital services operated by Héritage Montréal under its domains or subdomains.

These various services are collectively referred to as the “Sites”.

By accessing or using the Sites, the user acknowledges having read these Terms and agrees to comply with them.

Certain features or external platforms may be subject to their own terms of use. Where specific terms are expressly presented to the user for a given service, those terms apply to that service.

Use of the Sites is also subject to Héritage Montréal’s Privacy and Personal Information Protection Policy, which is a separate document from these Terms.

PROVISIONS APPLICABLE TO ALL SITES

3. Purpose of the Sites

The Sites are intended, in particular, to contribute to Héritage Montréal’s mission of advancing knowledge, awareness, protection, enhancement and transmission of the metropolitan region’s architectural, urban, landscape and cultural heritage.

The Sites may include, in particular:

news;
articles and blog content;
thematic features;
positions and statements;
resolutions;
news releases;
research and analysis;
publications;
reports;
briefs and submissions;
historical documents;
photographs and audiovisual content;
maps;
inventories;
documentary references;
educational resources;
information relating to Héritage Montréal’s activities, actions, campaigns and programs;
information concerning buildings, sites, complexes and territories;
citizen participation and mobilization tools;
data from institutional or third-party sources;
and various digital services and features.

The content, structure and features of the Sites may evolve over time.

4. Editorial content, publications and positions

Héritage Montréal’s main website and blog serve, among other things, as spaces for information, documentation, awareness, analysis, mobilization and expression of the organization’s activities and concerns.

Certain content may express an analysis, recommendation, concern, institutional position or opinion concerning, in particular:

a building;
a heritage complex;
a real estate project;
a development project;
a public policy;
a government or municipal decision;
a public consultation;
a by-law or regulation;
or any other issue related to Héritage Montréal’s mission.

Such content must be understood in the context and as of the date of its publication.

A situation may evolve after content is published, including as a result of:

a change to a project;
a new public decision;
a regulatory change;
new information becoming available;
an intervention by an owner or public authority;
a real estate transaction;
a restoration;
a transformation;
a demolition;
or the evolution of a file or of Héritage Montréal’s position.

Héritage Montréal has no obligation to retrospectively amend each of its articles, news releases, publications, positions or historical documents so that they reflect the current status of a file.

The publication date of any content must therefore always be taken into consideration by the user.

The continued online availability of older content does not mean that Héritage Montréal necessarily reiterates or confirms, at the time it is consulted, each item of information, analysis or position presented in that content.

Where content is signed or produced by a contributor, expert, partner, guest author or other third party, the opinions expressed do not necessarily represent those of Héritage Montréal unless otherwise indicated.

5. Nature, accuracy and value of information

Héritage Montréal takes particular care with the quality of the information published on its Sites.

However, content may come from numerous sources and may concern buildings, territories, projects, public decisions, administrative matters, heritage protections, regulations or situations that may change rapidly.

Despite reasonable efforts to ensure quality and updating, Héritage Montréal does not guarantee that information available on the Sites will at all times be accurate, exhaustive, complete, current or free of errors or omissions.

Information published on the Sites is provided exclusively for informational, awareness, documentation and mobilization purposes.

It is general in nature and does not under any circumstances constitute an official source, professional advice, expert opinion, recommendation, official interpretation or guarantee, including with respect to matters that are:

legal;
regulatory;
urban-planning related;
heritage-related;
architectural;
technical;
real estate-related;
administrative;
financial;
tax-related;
or professional.

Use of the Sites does not create any professional or advisory relationship between Héritage Montréal and the user with respect to the information consulted on the Sites.

5.1 Primacy of official sources

No information published on the Sites should be used as a substitute for laws, regulations, registers, permits, decisions, notices, maps, inventories, assessment rolls, databases or official documents issued by the competent authorities.

Where information concerns, in particular:

the heritage status of a property;
a heritage designation or protection;
a classification or citation;
a heritage inventory;
zoning;
an authorized use;
an applicable standard;
an easement;
a by-law or regulation;
a permit;
an authorization;
a demolition application;
an application for a regulatory amendment;
a real estate project;
an administrative decision;
a public consultation;
a proceeding before a public authority;
ownership or the legal characteristics of a property;
or any other situation that may have legal, administrative or regulatory effects,

the user must verify the information directly with the competent authority and consult the applicable official documents before making any decision or taking any action.

In the event of any discrepancy, incompatibility or contradiction between information published on the Sites and information from an official source, the official source prevails in all cases.

In particular, Héritage Montréal does not guarantee that a page, record, map, publication or article will immediately reflect:

the adoption or amendment of a by-law or regulation;
the issuance, amendment or cancellation of a permit;
a change in the heritage status of a place;
a recent administrative decision;
a change made to a project;
a sale or change of ownership;
a court decision;
a change to a government or municipal database;
or any other development occurring since its most recent update.

Information may therefore have been accurate when published but no longer correspond to the current situation when consulted.

Any person who chooses to act, refrain from acting, enter into a transaction or make a decision based solely on information published on the Sites does so at their own risk and remains responsible for carrying out the necessary verifications with the relevant sources, professionals and competent authorities.

6. Documents, publications and downloadable content

The Sites may allow users to consult, download, print or export various documents, including:

reports;
briefs and submissions;
publications;
guides;
maps;
news releases;
articles;
records;
data;
historical documents;
or other resources.

The technical ability to download, print or save a document does not constitute a waiver of any intellectual property rights that may apply to it.

Rights of reproduction and reuse are determined by:

the notices accompanying the document;
these Terms;
any applicable specific licences;
rights belonging to third parties;
and applicable laws.

Where a document includes a date, version number or notice indicating that it has been replaced or archived, the user must take that information into account.

Héritage Montréal may keep older or archived documents online for historical, documentary or reference purposes, without their continued availability necessarily meaning that they represent current information.

7. Acceptable use of the Sites

The user agrees to use the Sites lawfully and reasonably and not to compromise their operation, security or integrity or the rights of others.

In particular, it is prohibited to:

attempt to obtain unauthorized access to the Sites or their servers, systems or databases;
circumvent a security measure or access restriction;
intentionally introduce a virus, malicious software or any other harmful element;
compromise or attempt to compromise the security of the Sites;
unreasonably disrupt or overload their infrastructure;
impersonate Héritage Montréal or one of its representatives;
falsely represent an association, approval, sponsorship or partnership with Héritage Montréal;
use the Sites for fraudulent, defamatory or unlawful purposes;
automatically or massively collect personal information relating to users;
systematically reproduce or extract protected content in violation of these Terms, an applicable licence or the law.

These restrictions must not be interpreted as limiting rights expressly granted in respect of open data or content subject to a specific licence.

8. Héritage Montréal intellectual property

Subject to rights belonging to third parties and content expressly made available under a different licence, original content on the Sites is protected by applicable copyright, trademark and intellectual property laws.

This may include, as applicable:

texts;
articles;
features;
publications;
research;
analyses;
photographs;
videos;
illustrations;
maps;
graphic representations;
compilations;
the structure and organization of databases;
interfaces;
graphic elements;
logos;
trademarks;
program names;
and the design of the Sites.

Except where permitted by law, an applicable licence or authorization from Héritage Montréal, such content may not be reproduced, adapted, distributed, republished or substantially exploited without the authorization of the rights holder.

Subject to third-party rights, it is permitted to:

create a hyperlink to a public page;
use the sharing tools made available on the Sites;
make a copy or printout for personal consultation;
and quote excerpts in accordance with applicable laws, with acknowledgement of the source.

Substantial or systematic reproduction of content, creation of a new database from protected content or republication of content in its entirety requires authorization, except where the content concerned is expressly made available under a licence permitting such use.

8.1 Trademarks and visual identity

Names, logos, trademarks and visual identities belonging to Héritage Montréal may not be used in a manner likely to:

create confusion as to the origin of content;
suggest approval;
suggest sponsorship;
suggest an official association or partnership;
or harm Héritage Montréal’s image or rights.

Any such use requires prior authorization.

9. Photographs, archives and third-party content

The Sites may reproduce or display photographs, plans, archival documents, maps, illustrations, excerpts from publications, works, data or other content belonging to third parties.

Where a source, credit, collection or rights notice accompanies content, those indications must be respected.

The availability of content on the Sites does not mean that Héritage Montréal holds all rights in that content or that it may be freely reproduced.

A person wishing to reuse such content is responsible for verifying the applicable rights and, where necessary, obtaining authorization from the relevant rights holder.

Any authorization granted by Héritage Montréal can apply only to rights that Héritage Montréal itself is authorized to grant.

10. Hyperlinks and external content

The Sites may contain links to, in particular:

government or municipal websites;
public databases;
heritage institutions;
partner organizations;
media outlets;
publications;
social media platforms;
video platforms;
maps;
or other external websites and services.

These links are generally provided for informational or convenience purposes.

Héritage Montréal does not necessarily control the content, availability, evolution, security or practices of external websites.

The presence of a hyperlink does not, unless expressly indicated otherwise, constitute an endorsement of all content, products, services, policies or opinions of the external website.

A link may also become outdated or lead to content that has been moved, removed or modified.

11. Services and platforms operated by third parties

Certain features accessible through the Sites may be provided in whole or in part by external providers or platforms, including in relation to:

payments;
donations;
memberships;
online store services;
electronic communications;
multimedia content;
mapping;
forms;
hosting;
or technology services.

When the user accesses a service operated by a third party, that service may be subject to the third party’s terms, policies and practices.

Héritage Montréal does not control changes made by these providers to their services, terms, policies or platforms.

The collection and processing of personal information by Héritage Montréal and its providers are described in greater detail in Héritage Montréal’s Privacy and Personal Information Protection Policy.

12. Donations, memberships, online store and other transactions

The main website may allow the user, in particular, to:

make a donation;
become a member or renew a membership;
make a purchase;
or carry out certain other transactions.

Information, prices, taxes, delivery terms, benefits or other details specific to a transaction are those presented at the time the transaction is carried out.

An obvious technical or typographical error appearing on a Site does not bind Héritage Montréal where it can reasonably be identified as such, subject to any mandatory rights provided by law.

Payments may be processed by specialized providers. Héritage Montréal does not necessarily receive all financial information transmitted directly to the payment provider.

These Terms do not establish specific rules applicable to ticketing or to the conduct of Héritage Montréal activities.

13. Forms and communications submitted to Héritage Montréal

The Sites may allow a user to submit, in particular:

a question;
a comment;
a request;
a document;
a photograph;
a suggestion;
a correction;
an application;
a report or notice;
a documentary contribution;
or any other information.

The user must submit information in good faith and must not use forms to knowingly communicate content that is:

false or misleading;
fraudulent;
defamatory;
threatening;
hateful;
unlawful;
infringing privacy;
or infringing a third party’s intellectual property rights.

The user must submit only personal information reasonably necessary for the purpose of the communication.

Specific terms applicable to contributions intended to be published or integrated into Memento are set out below.

PROVISIONS SPECIFIC TO MEMENTO

14. Nature and purpose of Memento

Memento is an information, documentation, awareness and mobilization platform devoted in particular to metropolitan heritage, places of heritage interest and the issues affecting them.

Memento may, in particular, allow users to:

locate and discover places;
consult documentary records;
view geographic information;
consult issues associated with certain sites;
access external references and sources;
relate different data to one another;
report a situation or heritage issue;
contribute to enriching certain information;
consult data;
and download or reuse certain data where the applicable rights permit.

Information compiled in Memento may come, in particular, from:

Héritage Montréal;
the City of Montréal;
other municipalities;
the Government of Québec;
the Government of Canada;
other public bodies;
open databases;
inventories;
archives;
publications;
studies;
partners;
researchers;
citizens;
property owners;
or other third parties.

15. Memento is not an official register

Memento is not an official register and does not replace any register, inventory, assessment roll, map, geographic information system, database or document produced by a public authority.

The inclusion of a building, place, complex or territory in Memento:

does not confer any legal status on it;
does not constitute an official heritage designation;
does not necessarily mean that it benefits from legal protection;
does not confirm its zoning;
does not confirm the uses permitted there;
and does not constitute a decision or position of a public authority.

Conversely, the absence of a place from Memento does not mean:

that it has no heritage value;
that it benefits from no protection;
that no regulation applies to it;
that it is not affected by any issue;
or that no administrative or regulatory proceeding is underway.

The user must consult official sources and authorities to determine the current legal, regulatory, heritage or administrative status of a place.

16. Compilation and updating of Memento records

Memento records may result from the combination of several sources with different methods, objectives, reference dates and update frequencies.

Information may, in particular, have been:

imported;
transcribed;
selected;
grouped;
geolocated;
normalized;
adapted;
contextualized;
enriched;
or related to other information.

The date on which Memento is updated may therefore differ from the date of the original source.

Héritage Montréal does not guarantee instantaneous or permanent synchronization with the databases of source institutions.

Where the accuracy or currency of data is important to the user, the user must consult the original source directly.

17. Citizen alerts and reports

Memento may allow members of the public to report a situation concerning a place or heritage complex.

An alert or report may concern, in particular:

a risk of demolition;
vacancy;
poor maintenance;
a transformation;
a real estate project;
the loss of heritage elements;
or any other situation considered to be of concern.

An alert or report published on Memento does not constitute an official finding, professional expert opinion, legal determination or conclusion as to whether a situation is lawful or unlawful.

Publication of information from a third party does not mean that Héritage Montréal guarantees or confirms all statements submitted.

Héritage Montréal may, in particular:

verify;
request clarification;
supplement;
correct;
reword;
contextualize;
merge;
classify;
update;
refuse;
suspend;
archive;
or remove

a contribution or alert.

Héritage Montréal remains free to determine the content it publishes in Memento.

18. Contributions to Memento and CC BY 4.0 licence

When a user submits to Héritage Montréal text, a photograph, information, a correction, a reference, a document or any other content intended to be integrated into Memento, the user remains the holder of any rights they have in that content.

By submitting content intended for publication in Memento, the user agrees that the content will be made available to the public under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence, to the extent of the rights the user holds in that content.

Subject to its terms, the CC BY 4.0 licence allows any person, in particular, to:

copy and redistribute the content in any medium or format;
adapt, transform or build upon it;
combine it with other information;
integrate it into another database or publication;
and use it for commercial or non-commercial purposes.

Reuse must comply with the attribution requirements set out in the licence, including, as applicable, appropriately crediting the source or author, referring to the applicable licence and indicating changes made where required.

The user therefore understands that content submitted to Memento and published under this licence may be reused, reproduced, adapted, redistributed and incorporated into other works, publications, tools or databases by third parties, without further authorization being required, provided that the CC BY 4.0 licence is respected.

Publication under this licence does not transfer ownership of copyright to Héritage Montréal.

By submitting content intended for Memento, the user represents, to the extent applicable:

that they are the author of the content or hold the rights necessary to permit its distribution under the CC BY 4.0 licence;
that they are authorized to submit and make the content public;
that the content does not include third-party rights incompatible with this licence, except where those rights are clearly identified;
that publication of the content does not infringe copyright, image rights, privacy or any other third-party right;
and that the information submitted is provided in good faith.

Where a contribution includes an element belonging to a third party, including a photograph, work, plan, archival document or any other protected content, the CC BY 4.0 licence applies to that element only if the person submitting the contribution actually has the right to offer it under that licence.

Elements whose rights belong to third parties and that cannot be distributed under CC BY 4.0 must be identified as such.

Héritage Montréal may, in particular:

verify;
correct;
reword;
summarize;
translate;
geolocate;
normalize;
contextualize;
combine;
or adapt

a contribution before or after publication.

Where a modification is made to content distributed under CC BY 4.0, the modification may be indicated in accordance with the requirements of that licence.

Héritage Montréal remains free to refuse, suspend, modify, archive or remove any contribution from Memento.

Unless otherwise specifically indicated in connection with particular content, contributions submitted to Memento under this section and actually published as open data or open content are distributed under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence.

OPEN DATA

19. Data from open sources

Memento may integrate, reproduce, import, map, transform, combine or allow users to consult data from open data portals or other institutional sources.

The rights applicable to such data are determined by the institutions that make them available and by the licences associated with them.

Héritage Montréal does not claim ownership of data belonging to third parties merely because the data are accessible or presented in Memento.

Where a specific licence accompanies a dataset, that licence prevails over the general provisions of these Terms with respect to the rights to reuse that dataset.

20. Data already made public by source institutions

Data identified as open data and integrated, reproduced or reused in Memento come from sources that have previously made them publicly accessible.

These may include, in particular:

the City of Montréal, through its open data portal;
the Government of Québec, including through Données Québec;
the Government of Canada, including through the Open Government Portal;
other municipalities;
other public bodies;
or other institutions that make their data available under an open licence.

These data were made public by their source institution before being integrated into Memento.

Héritage Montréal is not responsible for their initial publication or for the decision to make them publicly accessible.

Memento serves, in particular, as a tool for:

reuse;
aggregation;
selection;
organization;
contextualization;
mapping;
linking;
visualization;
and dissemination

of data already made public by their source.

The presence of such data in Memento does not, in itself, constitute disclosure by Héritage Montréal of information that was previously private or confidential.

The presence of public data in Memento does not alter its source, status or applicable licence.

21. Open data and personal information

The preceding section applies only to data or information that the source institution has actually chosen to make public or distribute as part of an open dataset.

The mere fact that information can be found somewhere on the Internet does not mean that it constitutes open data or that it may be freely collected, reproduced or distributed.

Where open data include information concerning a person, Héritage Montréal relies, in particular, on the fact that the information was previously made public by the competent institution as part of the dataset concerned.

Where a person believes that information from an institutional source:

is inaccurate;
should no longer be public;
should be corrected;
or should be removed from the original dataset,

the institution that published the data remains the official reference source for any request concerning the original publication, its accuracy or its public status.

Héritage Montréal may nevertheless review a request concerning the display of that data in Memento and take any measures it considers appropriate, subject to its legal obligations.

Where data are corrected, modified or removed by their official source, Héritage Montréal may reflect that change in Memento according to its update processes and cycles.

22. City of Montréal open data

Certain data used in Memento may come from the City of Montréal open data portal.

Where the data concerned are made available under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence, their use and reuse remain governed by that licence.

The presence of these data in Memento:

does not transfer ownership of the data to Héritage Montréal;
does not alter their licence;
does not reduce the rights granted directly by that licence;
does not mean that Héritage Montréal was responsible for their publication;
and does not mean that the City of Montréal approves, sponsors or endorses Héritage Montréal, Memento or any particular reuse of the data.

Where the data are selected, organized, contextualized, enriched, mapped or combined with content produced by Héritage Montréal, any rights that may exist in those separate contributions do not alter the licence applicable to the original municipal data.

23. Government of Québec data and Données Québec

Memento may also reuse datasets made public by the Government of Québec, its departments, bodies or partners, including through Données Québec.

Each dataset remains subject to the licence identified by its producer or distributor.

Where a dataset is distributed under a Creative Commons licence, the user’s reuse rights and obligations are determined by the licence variant indicated in the record or metadata for the dataset concerned.

The licence indicated by the original source of the dataset prevails in all cases.

Integration of these data into Memento:

does not alter their licence;
does not transfer ownership of them to Héritage Montréal;
and does not mean that the Government of Québec or the producing body approves or endorses Memento or the use made of the data.

24. Government of Canada data

Memento may also integrate or reuse data and information made public by the Government of Canada, including through the Open Government Portal.

Where a dataset is made available under the Open Government Licence – Canada, its reuse remains subject to the terms of that licence.

Integration of these data into Memento:

does not alter their licence;
does not transfer ownership of them to Héritage Montréal;
does not mean that Héritage Montréal was responsible for their publication;
and does not mean that the Government of Canada approves or endorses Memento or the use made of these data.

Where different terms or a different licence are expressly indicated by the source of a dataset, those terms or licence prevail.

25. Attribution and reuse of open data

Where a licence requires acknowledgement of the source, the user reusing the data is responsible for complying with that requirement.

Depending on the applicable licence, attribution may be required to identify, in particular:

the producing or distributing institution;
the name of the dataset;
the applicable licence;
the original source;
and, where required, the fact that the data have been adapted or modified.

The user must verify the licence indicated by the original source before redistributing, publishing or reusing a dataset.

The open nature of a dataset does not mean that the other elements accompanying it in Memento are themselves distributed under the same licence.

Unless otherwise indicated, a licence applicable to third-party data does not automatically extend, in particular, to:

editorial texts written by Héritage Montréal;
analyses;
comments;
third-party photographs;
illustrations;
logos;
trademarks;
graphic identity;
navigation elements;
or other content added to the platform.

PRIVACY, OPERATION AND LIABILITY

26. Protection of personal information

The collection, use, disclosure, retention and protection of personal information by Héritage Montréal are governed by its Privacy and Personal Information Protection Policy.

This policy applies in particular to information submitted through:

forms;
donations;
memberships;
purchases;
subscriptions to communications;
alerts and reports;
contributions;
and other interactions with the Sites.

These Terms do not replace that policy.

Where the user uses an external service, information processed directly by that provider may also be governed by that provider’s policies and terms.

Rules relating to open data already made public by source institutions are set out in sections 19 to 25 of these Terms.

27. Security of the Sites

Héritage Montréal takes reasonable measures to ensure the security and proper operation of its Sites.

However, no website, computer network or Internet transmission method can be guaranteed to be entirely free of vulnerabilities, interruptions or risks.

The user remains responsible for taking reasonable measures to protect their devices, systems, software, accounts and data.

Any attempt to compromise the security of the Sites or to access a system, database or information without authorization is prohibited.

28. Availability and operation

Héritage Montréal seeks to keep the Sites accessible and functional, but does not guarantee that they will be permanently, continuously or promptly available or free of errors.

Interruptions may occur, in particular, as a result of:

maintenance;
updates;
technical problems;
provider failures;
network problems;
technological changes;
security incidents;
or circumstances beyond Héritage Montréal’s control.

Héritage Montréal may modify, suspend, replace or withdraw a feature, page, database or service.

29. Limitation of liability

To the fullest extent permitted by applicable law, Héritage Montréal cannot be held liable for damages arising, in particular, from:

inaccurate, incomplete, outdated or misinterpreted information;
the use of unofficial information as the basis for a decision;
an error or omission in data from a third party;
a delay between an official source and its update on the Sites;
a contribution or content submitted by a third party;
an interruption or unavailability of the Sites;
a technical error, failure or incompatibility;
an external link or service;
the modification or disappearance of external content;
loss of access to a feature;
or use of the Sites contrary to these Terms.

In particular, Héritage Montréal does not guarantee that information published on the main website, blog or Memento may be used for the purposes of a real estate transaction, permit application, administrative or judicial proceeding, professional expert assessment or any other process having legal, administrative or financial effects.

It is the user’s responsibility to obtain any necessary confirmation from the appropriate authorities, official sources or professionals.

Nothing in these Terms has the effect of excluding or limiting liability where such exclusion or limitation is prohibited by applicable law.

30. Reporting an error, content issue or infringement of rights

Héritage Montréal invites users to notify it where content accessible on its Sites:

contains a significant error;
appears outdated;
incorrectly attributes a document;
improperly uses a photograph or work;
appears to infringe copyright or another right;
raises an issue concerning personal information;
or requires particular verification.

Any request may be sent to:

contact@heritagemontreal.org

Where possible, it should indicate:

the address or title of the page concerned;
the information or content at issue;
the nature of the problem;
and any relevant source or documentation.

Submission of a request does not guarantee that the content will be modified or removed.

Héritage Montréal may carry out any verification it considers necessary before deciding what action to take.

31. Modification, archiving or removal of content

Héritage Montréal remains responsible for its editorial and documentary choices and may, in particular:

correct information;
update a page;
modify the presentation of content;
supplement content;
merge several items of content;
change a classification;
add a warning or clarification;
archive a publication;
move content;
make content inaccessible;
or remove it.

Héritage Montréal has no obligation to keep content, a page, a record or a feature online indefinitely.

Removal of a page from the public website does not necessarily mean that all archived or backup copies of the content have been deleted.

32. Amendments to these Terms

Héritage Montréal may amend these Terms to take into account, in particular:

changes to its Sites;
new features;
new practices;
new data sources;
changes to applicable licences;
technological changes;
or new legal requirements.

The date of the most recent update is indicated at the beginning of the document.

The version published on the Sites constitutes the version then in force.

Where necessary or appropriate, the user may be asked to accept the Terms again.

33. Severability

If any provision of these Terms is declared invalid, unlawful or unenforceable, the remaining provisions remain in force to the fullest extent permitted by law.

34. No waiver

Héritage Montréal’s failure to exercise a right or immediately enforce a provision of these Terms does not constitute a waiver of that right or provision.

35. Governing law and languages

These Terms are governed by the laws applicable in the Province of Québec and by the federal laws of Canada applicable therein.

These Terms may be made available in other languages for consultation purposes.

The French version constitutes the official and authoritative version of these Terms. In the event of any difference in interpretation between the French version and a translation, the French version prevails, subject to any rights the user may have under applicable law.

Subject to any mandatory rule to the contrary, any dispute relating to these Terms or the use of the Sites is submitted to the courts of competent jurisdiction in Québec.
